أصدرت لجان النظر في مخالفات أحكام نظام حماية البيانات الشخصية ولوائحه بالهيئة السعودية للبيانات والذكاء الاصطناعي «سدايا» عددًا من القرارات، بناءً على اختصاصها بالنظر في المخالفات وإيقاع العقوبات بموجب أحكام المادة (السادسة والثلاثون) من النظام، وقد صدر عن اللجنة خلال العام الماضي (48) قرارًا بثبوت المخالفة وفرض العقوبة المقررة نظامًا على جهات التحكم المشمولة في نطاق تطبيق أحكام النظام ولوائحه التنفيذية.

واشتملت المخالفات التي نظرتها اللجان على عدد من الممارسات التي تمثلت في جمع ومعالجة البيانات الشخصية، والإفصاح عن البيانات الشخصية دون مسوغ نظامي، وعدم اتخاذ جهات التحكم للتدابير التنظيمية والإدارية والتقنية المناسبة للمحافظة على البيانات الشخصية وحمايتها، بالإضافة إلى مخالفات متعلقة بإرسال رسائل دعائية ورسائل تسويقية لأصحاب البيانات الشخصية دون الحصول على موافقتهم وفق أحكام النظام.

وتأتي هذه الجهود في إطار المهمات المناطة بالهيئة السعودية للبيانات والذكاء الاصطناعي «سدايا» في الإشراف على تطبيق أحكام نظام حماية البيانات الشخصية ولوائحه التنفيذية، وذلك ضمن منظومة متكاملة تهدف إلى ترسيخ الممارسات المسؤولة في التعامل مع البيانات الشخصية، ورفع مستوى الالتزام بالأحكام النظامية ذات الصلة؛ لتحقيق الهدف الرئيسي من النظام المتمثل في حماية بيانات الأفراد، فضلًا عن تعزيز الثقة في التعاملات الرقمية.

The committees reviewing violations of the provisions of the Personal Data Protection Law and its regulations at the Saudi Data and Artificial Intelligence Authority "SDAIA" have issued a number of decisions, based on their authority to review violations and impose penalties under the provisions of Article (Thirty-Six) of the law. During the past year, the committee issued (48) decisions confirming violations and imposing the legally prescribed penalties on the data controllers covered by the scope of application of the law and its executive regulations.

The violations reviewed by the committees included several practices related to the collection and processing of personal data, disclosing personal data without legal justification, and the failure of data controllers to take appropriate organizational, administrative, and technical measures to maintain and protect personal data. Additionally, there were violations related to sending promotional and marketing messages to personal data owners without obtaining their consent in accordance with the provisions of the law.

These efforts come within the framework of the tasks assigned to the Saudi Data and Artificial Intelligence Authority "SDAIA" in supervising the application of the provisions of the Personal Data Protection Law and its executive regulations, as part of a comprehensive system aimed at establishing responsible practices in handling personal data and raising the level of compliance with the relevant legal provisions; to achieve the main objective of the law, which is to protect individuals' data, as well as to enhance trust in digital transactions.
